Terms of use
The practical terms for using My Merchant Desk.
These terms explain the service, annual membership and responsibilities that apply when you use My Merchant Desk.
Business identity
These terms are between you and Jonathan Giardina, trading as My Merchant Desk (ABN 78 901 864 414). In these terms, “My Merchant Desk”, “we”, “us” and “our” refer to that business.
Agreement
By using the website, creating an account or purchasing a membership, you agree to these terms. If you do not agree, do not purchase or use the member toolkit.
The service
My Merchant Desk provides self-service tools for Australian eBay sellers to organise transaction reports, estimate profit, review missing information, manage stock-cost records and create exports for further review.
The service does not provide accounting, tax, financial or legal advice. Calculations depend on the source data and information you enter. You should check important figures against your original records and obtain professional advice where appropriate.
Accounts and eligibility
You must provide an email address you control and keep access to that address secure. Account access uses a one-time code. You are responsible for activity undertaken through your account and for notifying us promptly if you suspect unauthorised access.
Annual membership
The founding membership is available to eligible new members who join by 15 November 2026. It costs A$39 per year and renews automatically each year unless cancelled before the next renewal date. The founding renewal rate remains A$39 while that membership stays continuously active. If a founding membership is cancelled and the customer later rejoins, the membership price available at that later time will apply.
The checkout page shows the amount due, billing frequency and renewal terms before payment. You can cancel future renewal through your account’s billing controls. Cancellation stops the next charge and access ordinarily continues until the end of the paid membership period.
Acceptable use
You may use the service for your own legitimate selling and record-keeping activities. You must not misuse the service, attempt unauthorised access, interfere with its operation, introduce malicious material, resell access, or use it unlawfully.
Your records and backups
The current toolkit stores imported seller records locally in your browser. You are responsible for checking your records and keeping suitable backups. We are not responsible for local records lost because browser storage is cleared, damaged or unavailable, except to the extent responsibility cannot lawfully be excluded.
Availability and changes
We aim to keep the service available and accurate but cannot promise uninterrupted or error-free operation. We may maintain, improve or change the service where reasonably required. If a material change adversely affects a paid membership, we will provide reasonable notice where practicable.
Consumer rights
Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
Third-party services and names
Payments, email delivery and authentication rely on third-party providers. Their separate terms may also apply. My Merchant Desk is an independent service and is not affiliated with or endorsed by eBay.
Liability
To the maximum extent permitted by law, we are not responsible for indirect or consequential loss, lost profits, tax outcomes, or decisions made solely from an estimate produced by the toolkit. This limitation does not apply where liability cannot lawfully be limited.
Suspension or termination
We may suspend or terminate access where reasonably necessary to address fraud, security risk, unlawful use, serious misuse or a material breach of these terms. This does not affect any rights or remedies available under law.
Governing law
These terms are governed by the laws of South Australia and applicable Commonwealth laws of Australia.
